Terms of Service

§ 1. Ordering

Products/services can be ordered from Woodbird® via our website, by phone/email, or in person. All contracts are concluded in Danish. All stated prices include VAT and other taxes. Prices are daily prices.

When returning a product, you are responsible for any costs associated with the return. The attached return form must be completed, indicating whether you want a refund (if possible according to legislation) or an exchange of the item. We will pay for the shipping back to your address for an exchange once we have received your returned package.

Expect this process to take up to 7 days. 

§ 2. Payment

We offer payment by credit card (Dankort, Mastercard, Visa) or by invoice (business customers only). No fees are charged when ordering on woodbird®, so you only pay for what you order.

When paying by credit card, you are always protected against misuse. You can reject a payment when you receive your payment statement. You have no liability if your card is misused in an online store that uses SSL (Secure Socket Layer) in its payment system. Thus, you are better protected than in the physical world, where you have a liability of DKK 1,200 if your card is misused using the PIN code.

Data sent in connection with purchases paid by card is encrypted (SSL) and can only be read by Nets (PBS). Neither woodbird® nor others can read this data.

The amount for the goods is only deducted when the package is shipped from Woodbird®. No amount greater than what you approved at the time of purchase can ever be charged.

§ 3. Delivery and Shipping

We ship within Denmark at a price of DKK 29.00 per order for delivery to a parcel shop. For orders over DKK 599.00, delivery to a parcel shop is free.

For "standard delivery" (to your door), the price is DKK 49.00 per package regardless of the total order amount.

If you want an order shipped abroad, to Greenland, or the Faroe Islands, this can only be done by prior agreement with Woodbird®. Delivery is made via GLS. If there are unexpected errors or deficiencies in an order sent from us, please contact us as soon as possible after receiving the order.

  • DELIVERY OUTSIDE DK: 3-4 working days

Returns

If you wish to return your order and possibly exchange it for another, this can be done within 14 days after receiving the item. You will find an enclosed return label you can use. This costs DKK 29 and will be deducted from your credit note/refund along with any refunded amount. You can also return the item yourself, but then you bear the cost yourself. Items not delivered directly to the address will not be accepted.

Flexible Delivery: If you choose to specify a location where our supplier/courier may leave the package, Woodbird® disclaims responsibility for the item, and the responsibility transfers to the buyer as soon as the package is scanned as delivered at the address by the courier. This applies, for example, if you write that the package may be left in a shed, garage, etc.

Stock Status: All items on woodbird® are normally in stock. However, errors may occur in some cases, making the inventory not 100% up to date and resulting in longer delivery times. If this happens, you will of course be contacted immediately.

§ 4. Conclusion of Agreement

You must accept the terms and conditions with every purchase. You are encouraged to read the terms carefully.

On woodbird®, purchase agreements with children and young people under the age of 18 can only be concluded by parents or others who are legally authorized to act on behalf of the child or young person.

§ 5. Warranty

As a consumer, you have a 2-year warranty, which means you can have the item repaired, exchanged, refunded, or receive a discount depending on the specific situation. This of course requires that the complaint is justified, and that the defect has not arisen due to incorrect use of the product, lack of maintenance according to the manual, or other damaging behavior.

Complaints must be made within a reasonable time after you have discovered the defect. If you complain within 2 months, the complaint is always considered timely.

We will refund reasonable shipping costs you may have in connection with returning the item when the complaint is justified.

When you wish to complain about a product, it must be sent to our address (only after prior agreement), along with the enclosed return slip found in the package:

Note! We do not accept packages sent COD, without delivery, or similar.

Always send the item back in proper packaging; it is always a good idea to keep the original packaging and obtain proof of shipment so we can refund your shipping costs.

If Woodbird® finds no defect in the product upon receipt of a complaint, the customer will not be reimbursed for the item's value. Therefore, it is important that you describe the defect as accurately as possible.

When we have received your item, we will send you an email with information about the further process.

§ 6. Personal Data

To shop at woodbird®, the following information is required:

  • Name

  • Address

  • Email address

  • Mobile number

This information is stored along with details of what you have purchased for 5 years from the end of the financial year to which the information relates, in accordance with the Accounting Act §10, after which the data is deleted.

Information is not disclosed or sold to third parties unless this occurs as part of a restructuring or a complete or partial sale of the company. Any disclosure in such a situation will be in accordance with the applicable data protection laws.

As a customer, you have the right to access our registration of data about you, and you can object to a registration under the rules of the Personal Data Act by contacting NoBRAKES ApS via email: contact@woodbird.dk.

§ 7. Right of Withdrawal

You always have a 14-day right of withdrawal when shopping at woodbird®, and this right runs from the day you receive your item. The right of withdrawal can only be exercised if the item is returned in the same condition and quantity, and the right lapses if you use the item in a way that clearly reduces its resale value.

The packaging must therefore always be returned to meet the conditions for exercising the right of withdrawal.

Note! Your right of withdrawal lapses if you use these items, as this will significantly reduce their resale value, according to the Consumer Agreement Act § 20, section 3, no. 1.

If you exercise your right of withdrawal, you must pay for the return postage yourself.

You can also withdraw by refusing to receive the item at the post office or by delivering it personally to the above address. When you withdraw from your purchase, the purchase amount will of course be refunded to you. This is done by transferring the amount to your bank account once we have received the item and checked that it meets the withdrawal conditions. Therefore, it is important that we are informed of your registration and account number.

It is not a requirement but will expedite processing if complete information is included with the package — for example, a copy of the order confirmation, bank details for the refund, a copy of prior correspondence, etc. Note — we do not accept packages sent COD.

It is always a good idea to keep the original packaging until you have decided whether to keep the purchased item. The packaging may in some cases affect the item's resale value and thus your ability to exercise the right of withdrawal. If an item returned due to the 14-day right of withdrawal is damaged due to poor packaging, Woodbird® is absolved of any responsibility to refund the item's value. If the right of withdrawal is exercised, Woodbird® will refund the full purchase price including shipping costs.

Returns (again)

The same return policy as above applies. For business customers, there is no right of withdrawal unless otherwise agreed in writing between the customer and Woodbird®. Business customers are considered to be private companies, public institutions, associations, foundations, and self-governing institutions.

§ 8. Confidentiality

Personal information is treated with strict confidentiality by Woodbird®. Entered information is processed encrypted and is never shared with third parties.

§ 9. Cookies

9.1 Cookies, Purpose and Relevance

We use cookies to collect information about you, which is used to customize and improve our content and increase the value of the ads shown on the site.

If you do not want information collected, you should delete your cookies (see the instructions under section 9.2) and refrain from further use of the website. Below we explain what information is collected, their purpose, and which third parties have access to them.

9.2 What are cookies?

The website uses "cookies," a text file stored on your computer, mobile, or similar device to recognize it, remember settings, perform statistics, and target ads. Cookies cannot contain harmful code such as viruses.

If you block or delete our cookies, the website may not function optimally, and you may not be able to access some content.

9.3 Which cookies are set

    We use marketing and optimization cookies to ensure optimal operation of our website. This includes Google Analytics, which we use to analyze how you use our site. The collected information is sent and stored on Google's servers.

§ 10. Rights of the Data Subject

10.1 Right to access your personal data

You have the right at any time to know what personal data we process about you, where it comes from, and what we use it for. You can also know how long we store your data and who receives it, if we disclose it domestically and/or abroad.

If requested, we can provide you with a copy of the data we process about you. Access may be limited to protect other people's privacy, trade secrets, and intellectual property rights. You can exercise your rights by contacting us.

10.2 Right to have inaccurate data corrected, limited, or deleted

If the data we process about you is inaccurate, you have the right to have it corrected or limited. You must contact us and inform us of the inaccuracies and how they can be corrected or limited.

In some cases, we are obliged to delete your personal data, for example if you withdraw your consent. You can also ask for deletion if you believe the data is no longer necessary for the purpose we collected it for, or if you believe the data is being processed illegally.

When you make a request to correct, limit, or delete your data, we will investigate whether the conditions are met and implement changes or deletions as soon as possible.

10.3 Right to object to our processing of your data

You have the right, due to your particular situation, to object to our processing of your personal data. You can also object to our disclosure of your data for marketing purposes. Use the contact details above to send an objection. If your objection is justified, we will stop processing your data.

10.4 Right to data portability

You may have the right to data portability to the extent that processing is automated. Data portability means you have the right to receive personal data about yourself that you have provided to us in a structured, commonly used, and machine-readable format and the right to transfer this data to another controller without hindrance.

10.5 Complaint

If you wish to complain about our processing of your personal data, including if we have not met your request under sections 9.1–9.4, you also have the option to contact the Danish Data Protection Agency at dt@datatilsynet.dk.

§ 11. Governing Law and Venue

Any dispute is decided according to Danish law by the ordinary courts.
